Membership Terms & Conditions

1. Acceptance of Terms:
  • By becoming a member with 123Hub, you agree to comply with and be bound by the terms and conditions outlined herein. If you do not agree with any part of these terms, please do not proceed with membership.

2. Membership Eligibility:

  • Membership is open to individuals and businesses meeting the criteria set by 123Hub. We reserve the right to refuse membership to any applicant without providing a reason.

3. Membership Fees and Invoicing:

  • Membership fees will be invoiced monthly in advance and are due and payable upon receipt. Late payments may incur additional fees. Invoices will be sent electronically to the email address provided by the member.

4. Late Payment

  • A late fee will be applied to any outstanding balance not paid within [number] days from the due date. Continued failure to pay may result in the suspension or termination of membership. 

5. Security Deposit:

  • A security deposit may be required upon membership enrolment. This deposit will be held to cover any damages to the space or outstanding fees and will be refunded, less any deductions, upon termination of the membership.

6. Membership Renewal:

  • Memberships automatically renew on a month-to-month basis unless terminated by either party with a [number]-day notice. Members are responsible for notifying 123Hub of their intention to terminate.

7. Changes to Membership Fees:

11. Governing Law:

Booking and Payment:
The Cafe123 Kitchen is a shared use facility, and 123Hub will control the times and manner of all Users access to and use of the Kitchen.

  • All café bookings are subject to availability and must be made in advance.
  • A deposit or full payment, along with a security deposit, may be required to secure the booking.
  • Payment must be made in full prior to the commencement of the booking.

Cancellation and Refunds:

  • Cancellations made within 7 days of the booking date may incur a cancellation fee.
  • Refunds for cancellations are subject to our discretion and may be subject to administrative fees.
  • No refunds will be provided for cancellations made within 72hours of the booking time.
Café Usage:

  • Café  must be used only for the purposes agreed upon at the time of booking.
  • The hirer is responsible for leaving the café in the same condition as it was found, including cleaning up after any catering.
  • Any damage to the kitchen or its contents will be the responsibility of the hirer and may incur additional charges.
  • Limited cutlery and cookware is available. User may supply personal equipment if preferred. Please discuss all small
    ware needs with the 123Hub Manager before your first session.
  • Cleaning supplies (paper towels, sanitizer, side towels, dish soap, and floor cleaning supplies) are provided by 123Hub.
    Users may supply their own personal use items (aprons, hair restraints, and gloves).

Access and Security:

  • Access to the café will be provided at the agreed-upon time and for the duration of the booking only.
  • The hirer is responsible for the security of the café during the booking period.

Additional Charges:

  • Charges for extended booking periods, additional services, or damages will be deducted from the security deposit or billed separately.

Health and Safety:

  • The hirer must comply with all health and safety regulations and guidelines during the booking period.
  • Any hazardous materials or activities are strictly prohibited.
  • No children under 16 are allowed in the kitchen when any food processing is taking place. 

Behaviour Policy:

  • The hirer and their guests must conduct themselves in a manner that is respectful to staff, other guests, and the premises.
  • Any behaviour deemed inappropriate or disruptive may result in the termination of the booking without refund.

Liability:

  • 123Hub does not accept any liability for loss, damage, or injury to persons or property during the booking period.
  • The hirer is responsible for obtaining appropriate insurance coverage for their activities.

Termination of Booking:

  • 123Hub reserves the right to terminate the booking at any time due to breach of these terms and conditions or for any other reason deemed necessary.
  • In the event of termination by 123Hub, a refund may be provided at our discretion.
  • 123Hub has the right to cancel the appointment of any client who is suspected to be under the influence of alcohol or drugs. 

General:

  • These terms and conditions are subject to change without notice.
  • By making a booking, the hirer agrees to abide by these terms and conditions in their entirety.

Tutoring TERMS & CONDITIONS

Our Tuition is committed to protecting and respecting your privacy.
1. Information collection

  • In order to provide a better service to you, we may collect and process the following data about you:

a) information that you provide by filling in forms on our site. This includes information provided at the time of registering to use our site, subscribing to our service, posting material or requesting further services. We may also ask you for information at other times, for example in connection with a promotion or when you report a problem with our site;
b) if you contact us, we may keep a record of that correspondence;
c) details of transactions you carry out through our site and of the fulfilment of your orders;
d) details of your visits to our site and the resources that you access.

  • We only retain personal data for so long as it is necessary. Data may be archived as long as the purpose for which the data was used still exists.

a) ensuring that content from our site is presented in the most effective manner for you and for your computer;

  • We intend to use your data in direct marketing and we require your consent (which includes an indication of no objection)for that purpose. By using our site, unless you tell us otherwise, you agree that:
a) your name, contact details (including address, contact number, email address), products and services information, transaction pattern and behaviour, background and demographic data held by us from time to time may be used by us in direct marketing;

  • the following classes of services, products and subjects may be marketed to you:

a) services and products related to our site and/or our affiliates (including marketing affiliates programs we are a part of);
b) reward, loyalty or privileges programmes, promotional offers and related services; and
c ) invitations to events such as seminars/webinars/tele-seminars, conferences, live programs or events.

  • We may conduct direct marketing via fax, email, direct mail, telephone and other means of communication or send e-newsletters to you. You may choose not to receive promotional materials, by simply telling us (see below for contact details), and we will cease to do so, without charge.

We will keep the personal data we hold confidential but may provide information to:
  • personnel, agents, advisers, auditors, contractors, financial institutions, and service providers in connection with our operations or services;
  • our offices, affiliates, business partners and counterparts (if any);

You, the client of 123HUB Tuition
1. Definitions

  • Academic Personal Trainer means the tutor (Academic Personal Trainer/APT) assigned by us to provide the Services.
  • Fee means our fee for your selected Plan together with any other fee payable pursuant to these Terms & Conditions.
  • Plan means the 123HUB Tuition plan offered and selected by you for the Term for the provision of Services.
  • Services means the services to be provided to you and the student pursuant to your selected Plan. The services may include Tuition Sessions and such other services offered by us pursuant to the selected Plan.
  • Student means a student who undergoes Tuition Sessions and receives the benefit of the Services pursuant to this Agreement.
  • Term means the duration of the package purchased.
  • Tuition Session means a tutoring session between an Academic Personal Trainer and a student pursuant to your selected Plan.
2. Engagement
  • You engage us to provide Services to you and the Student on these Terms & Conditions.
  • These Services will automatically renew for another Package Term unless the student has finished year 12 or you advise us in writing prior to expiration of the Package Term that you do not wish for the Services to continue for a new Plan. If you pay the Fee for the new Plan or your student attends a session for the new Plan, you are automatically deemed to have accepted the Services for the new Plan.
  • These Terms & Conditions can only be varied by written notice to you.
  • You must advise us of any change in contact detail (address, email and/or telephone). We will not be responsible in any respect if you do not advise us of any contact detail change.

3. Cooling Off Period

  • You have a 2-week cooling off period commencing on the date of the first Tuition Session of each Plan.
  • During the cooling off period, you may choose to cancel the Plan and these Terms & Conditions by written notice to us.
  • We will only charge you for the Tuition Sessions within that 2-week period if you terminate these Terms & Conditions during the cooling off period. Your remaining paid balance will be refunded to you.

4. Services

  • Provided you pay the Fee, we will provide the Services in accordance with your selected Plan.
  • You agree to use the Services consistently based on your Plan. The Services may not be effective if they are not consistently used by you.
5. Plans
  • Each Plan contains different features. The features of any Plan may change from time to time.
  • We may recommend a Plan based on information you provide to us.
  • We may, on advice of the Academic Personal Trainer, recommend that a Plan or the format of Tuition Sessions be reviewed, varied, or amended before the commencement of a new Plan.
  • You may change a Plan at the end of each Package Term provided you pay the relevant Fee for that altered Plan.
4. Fees
  • We will charge you the Fee for your selected Plan.
  • The Fee for a Term is non-refundable where:
a) you cancel the Services during a Plan; or
b) we terminate these Terms & Conditions because of your breach of these terms and conditions.

  • A Fee may be charged for cancellation of a Tuition Session or as otherwise specified in these Terms & Conditions.
  • We may vary the Fees at any time; however, we will not vary the Fee during a Plan.
  • You may be charged an additional Fee if:
a) you pay the Fee by way of credit card or direct debit;
b) any payment of the Fee is dishonoured or declined; or
c) we are required to take action to recover any overdue amount from you (including legal expenses on a solicitor/client basis, collection agency charges (if permissible by law) or any other reasonable associated cost)

  • Fees are inclusive of GST and in Australian dollars.

5. Credits

  • We may give you credit for any unused Services.
  • If we give you credit, we will advise you of the terms and conditions applying to use of that credit.
  • Credit is given in the sole discretion having regard to your circumstances.
6. Tuition Sessions
  • Tuition Sessions will be conducted:1.
a) at such times agreed upon between 123HUB and the Academic Personal Trainer;
b) within the 123HUB premises
  • We will provide you with a booking confirmation of your Tuition Session within 24 hours of such session. If you do not receive a booking confirmation, you do not have a valid booking.
7. Cancellation - Tuition Sessions
  • 123HUB Tuition Sessions may only be cancelled or rescheduled with 24 hours’ notice in writing.
  • Any Tuition Session cancelled within 24 hours will incur the usual Fee (and not a credit).
  • Any cancelled Tuition Session must be made-up before expiry of the plan period.
8. Academic Personal Trainer
  • We may change your Academic Personal Trainer either at our discretion or at your request.
  • You may discuss concerns about your Academic Personal Trainer with your nominated success manager at any time.
  • Time spent by an Academic Trainer with you, or your Student outside Tuition Sessions may incur an additional Fee.
  • You and the Student must treat the Academic Personal Trainer with respect at all times. Any abuse, threatening harmful or like conduct to our Academic Personal Trainers will be a breach of these Terms & Conditions.
9. Liability
  • We do not, and cannot, warrant or guarantee the desired grade result of any Student and do not accept responsibility or liability for a Student's overall performance in any examination or on an assessment piece.
  • These Terms & Conditions are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, or obligations. If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at its option:

a) in the case of goods: the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of having the goods repaired; and
b) in the case of services: the supply of the services again; or the payment of the cost of having the services supplied again.

10. Termination

  • You may terminate the Services/your Plan during a Plan at any time by providing us with written notice, however, you will
  • not
  • receive a refund of any Fees paid and you will be liable for the balance of any Fees owing for the Term.
  • We may terminate or suspend the Services/your Plan if you breach these Terms & Conditions and fail to remedy the breach within 10 days of request by us to do so.
  • We may terminate or suspend the Services/your Plan if you fail to pay any of the Fee.
  • We may terminate this agreement if we cease to operate the business which provides the Services/your Plan.
  • All unpaid Fees become payable upon termination of these Terms & Conditions for any reason.
11. Queries
  • Your Academic Personal Trainer will be your primary contact for queries on the Services or your Plan.
  • If your Academic Personal Trainer is unable to assist you, your nominated success manager will be available by phone or email to answer your queries regarding the Services during normal business hours.
12. Generally
  • You and the Student will abide by our policies and procedures for the provision of the Services as may be reasonably required from time to time.
  • We own all intellectual property rights pertaining to the Plans, the Services and any and all documentation, resources, material or content provided by us to you or the Student.
  • You must not assign, sublicense or otherwise deal in any other way with any of your rights under these Terms & Conditions.
  • These Terms & Conditions are governed by the laws of Queensland, Australia. Each party submits to the jurisdiction of the courts of Queensland, Australia.
  • You should review our Privacy Policy located at https://ateamtuition.com/privacy-policy/. We may share information about students with any 123HUB Tuition partner school unless you provide us with written notice to the contrary.


Our Tuition is committed to protecting and respecting your privacy.

1.Information collection
In order to provide a better service to you, we may collect and process the following data about you:
a) information that you provide by filling in forms on our site. This includes information provided at the time of registering to use our site, subscribing to our service, posting material or requesting further services. We may also ask you for information at other times, for example in connection with a promotion or when you report a problem with our site;
b) if you contact us, we may keep a record of that correspondence;
c) details of transactions you carry out through our site and of the fulfilment of your orders;
d) details of your visits to our site and the resources that you access.

We only retain personal data for so long as it is necessary. Data may be archived as long as the purpose for which the data was used still exists.

2. Uses made of the information
The purposes for which information may be used by us include:
a) ensuring that content from our site is presented in the most effective manner for you and for your computer;
b) providing you with alerts, newsletter, education materials or information that you requested or signed up to;
c) carrying out our obligations arising from any contracts entered into between you and us;

e) designing and conducting surveys/questionnaires for client profiling/segmentation, statistical analysis, improving and furthering the provision our products and services;
f) complying with laws and regulations applicable to us or any of our affiliates in or outside Australia;
g) legal proceedings, including collecting overdue amounts and seeking professional advices;
h) researching, designing and launching services or products including seminars/events/forums;
i) To perform service; or
j) purposes directly related or incidental to the above

  • We intend to use your data in direct marketing and we require your consent (which includes an indication of no objection)for that purpose. By using our site, unless you tell us otherwise, you agree that:
a) your name, contact details (including address, contact number, email address), products and services information, transaction pattern and behaviour, background and demographic data held by us from time to time may be used by us in direct marketing;
the following classes of services, products and subjects may be marketed to you:
a) services and products related to our site and/or our affiliates (including marketing affiliates programs we are a part of);
b) reward, loyalty or privileges programmes, promotional offers and related services; and
c ) invitations to events such as seminars/webinars/tele-seminars, conferences, live programs or events.

We may conduct direct marketing via fax, email, direct mail, telephone and other means of communication or send e-newsletters to you. You may choose not to receive promotional materials, by simply telling us (see below for contact details), and we will cease to do so, without charge.
